Reproductive technologies. Legal assistance in Surrogacy

The case of the surrogate mother in Louisville, who gave birth to a boy and had to fix the fact of the voluntary denial of paternal rights in the district court in 1980, is considered to be the first one appealing to legal support.  Since that application of assisted reproductive technologies is tightly connected with jurisprudence.  Moreover, it turned to be that for the last years it is  biological parents of  a child who need legal protection.

Ukraine is one of a few countries in the world where appliance of majority of assisted reproductive technologies, especially surrogacy, is absolutely legal. In this sphere Ukrainian legislators have proven to be more progressive than the main part of their western colleagues.

Surrogacy in Ukraine is much easier and cheaper than in Europe and the USA. An increasing amount of prospective parents, who choose Ukraine as their surrogacy final destination, come to Ukraine.

According to the new Family Code of Ukraine (art. 123, p.2) if a surrogate mother becomes pregnant via embryo transfer, conceived by the spouses, the spouses shall be the parents of the child, including surrogate programs. Thus, spouses, resorting to reproductive technologies, have complete parental rights and responsibilities concerning children born with the help of assisted reproductive technologies.
